Each member of Shell-Club obtains the authorization
to recruit new members. The member commits to obey the Nettiquette and
applicable law and not to cause any damage to Shell-Club with illegal advertising
(for example: spam-mails). In case of infringe the provisions the member will be
disqualified immediately.
As a compensation for loss any free assets will be collected by Shell-Club.
There is no obligation for the member to recruit
new members. New members, that do not come over reference of another member,
are integrated according to the coincidence principle into the system.
Members, that are added over reference, are integrated in the order of the
registrations to the next free space under this member.
A right of assignment of new members exists only,
if the own account exhibits a positive covering. If an account is not balanced,
every right to allocation and commission expires. The new member is assigned to
the next member with positive account covering in this case.
The monthly fees are always prescribed balanced for the account
on every 10th each month for the next month and. It is incumbent on the member to adjust
its account up to the last day of the month. The commission assignment can take place only
if the account exhibits a positive covering on the 1st day of the month at 0:00 o'clock
(BEFORE the commission assignment). If the monthly contribution is paid by bank-transfer,
the receiving-date applies debt-liberating. If one pays by credit card, covering enters
into force immediately. If the payment is back-demanded by the credit card enterprise,
possibly credited commissions are to be paid back, since at the time a covering was not
given to the commission. If the monthly contribution is late deposited, a
requirement on commission exists in the subsequent month only again - subject to the
positive covering of the account.
The attempt to manipulate the system, to chop servers of Shell-Club
or other illegal actions against Shell-Club or its members, lead without exception to the
immediate exclusion and to the criminal announcement.
To the disbursement of the commissions applies a minimum amount of
€ 31, - as agreed. The disbursement exclusively takes place to the bank account
indicated by the member. Disbursement expenses are to be carried at a full value by the
member.
A commission depends on the deposit in time of the team-members.
If the amount was not paid or was late deposited, no commission can be taken
into account for the current month.
A member can put its account quiet at any time. This is done
by suspending the payments. In order to be able to use the account further and be again
commission-entitled for members already assigned, however the amount in full height,
accumulated during the quiet-period, must be paid. A member can quit its account
at any time. In this case the assigned members are assigned to the notice to the members
over his place. A later entrance is only possible as a new entrance. An assumption of the
old members to a new account is not possible.
Shell-Club reserves itself the right to exclude members at any time
from the system if we get knowledge about that the member offends against regulations of
Shell-Club or its acting for Shell-Club means a disadvantage.
The offered shells may not be used for illegal purposes.
Any knowledge of illegal activities entails the immediate exclusion of the member
concerned. Contributions already paid are not paid back in the case of an exclusion.
Court of jurisdiction is Vienna / Austria.
